The initiatives promoted are part of a broader framework of interventions aimed at mitigating and containing the damage resulting from creditors' aggression.
The association pursues the objective of encouraging correct debt advice , while promoting adequate financial education and a balanced approach to responsible consumption . For small businesses, it intends to encourage the continuity of entrepreneurial activity, protecting the fundamental right of every individual to maintain a dignified standard of living .
The aim is to find a sustainable balance between two fundamental rights:
- on the one hand, the creditor 's right to recover, even partially, his credit;
- on the other hand, the debtor 's right to satisfy obligations within the limits of his actual income capacity, protecting what is necessary for his own support and that of his family.
In this balance, the association is also committed to combating the pathological dynamics often associated with situations of need, such as usury and gambling addiction .
In this perspective, ASCOLTO ATTIVO, as an associative body with legal personality, has entered into an agreement with the National Association for the promotion, organization and management of the integrated system of Social Services - Civic, Solidarity and Social Utility Purposes "i Diritti del Debtore".
This agreement provides for:
- promote knowledge of the tools offered by Law 3/2012 and the Corporate Crisis and Insolvency Code (Legislative Decree 14/2019);
- establish a Debt Crisis Resolution Body (OCC) in the territory.
Since over-indebtedness today represents a social phenomenon rather than a legal one , it is precisely from the social fabric that we must start again. Our commitment is aimed at the rehabilitation of the debtor and his reintegration into the market , freeing him from the burden of previous debts and giving him back concrete prospects of life and work.
